PUPPY CONTRACTS

Buyer is aware that there is a non-refundable deposit of $500.00 to hold a puppy. The holding fee is a commitment to purchase a puppy and can be transferred to another litter for various reasons (wrong sex, color etc ) if need occurs. The remaining balance is to be paid when the puppy is picked up at 8 weeks of age. Any shipping and crate fees are in addition to the cost of the puppy.

The puppy is to be picked up or shipped by no later than 12 weeks of age UNLESS prior arrangements are made with the seller, or the buyer forfeits all monies paid and then the puppy can be resold. The only exception is puppies being shipped out of country. They need to be 12 weeks of age.

Seller does not warranty puppies while being shipped. Seller has no control over their care or handling during transport. If buyer needs to have puppy shipped, it will be done so at buyer's expense. Buyer is responsible for finding and booking shipment of puppy. There are puppy nannies available in almost any area.

Buyer certifies that he/she is not acting as an agent for another individual in the purchase of this puppy. They will not sell this puppy to any mass-producing Breeder (puppy Mill) or business. This puppy must not be sold to any other person.

The seller will be available to answer any question and give advice about the puppy. This includes their diet, temperament, energy level, size, etc. We want the best for our dogs and new owners so we will do our best to answer all your questions in a timely manner. Having said that your veterinarian office should always be your first contact in any circumstance involving the health and well-being of your puppy.

This puppy/dog will be an indoor pet. Although Australian Shepherds have a double coat which helps regulate body temperature it can become too hot or too cold for them.

​

Buyer understands that most Aussies love to swim. Precautions must be made to ensure the safety of your puppy/dog around large bodies of water, fast moving water, or swimming pools. Life jackets are highly advised around any of these. It's better to be safe than sorry.

​

The buyer agrees to provide the dog with the appropriate exercise, diet, shelter, and general care of an Aussie and properly maintain its adequate needs, including its size and weight. The buyer further agrees to provide regular veterinary care including, checkups, vaccinations and any other care the dog will need. This could include deworming, flea and tick if travelling to certain places or if you live in certain places, any illness, injuries, teeth etc.

The buyer agrees that Absinth Australian Shepherds may continue to use the dog's name, picture and/or information for advertising with or without other dogs. Buyer agrees to keep in close contact with the seller for the life of said puppy/dog. The seller would like occasional updates and pictures showing the growth, development and activities of said puppy/dog. The seller would like to follow your pup on any social media accounts you might set up for them. We enjoy seeing the antics of these beautiful puppies/dogs.

The puppy/dog cannot be bred for any reason and will be in violation of agreement. We, Absinth Australian Shepherds, will take full legal action for Breeding Violations. Buyer must have puppy spayed or neutered no earlier than 6 months of age, and before 1 year of age as per our vet. Proof of spay or neuter must be provided to Absinth Australian Shepherds. Breeding dog will result in the buyer paying a $2000.00 voluntary payment in damages and will be responsible for all court and lawyer costs associated with this matter.

If the buyer is unable to care for the puppy/dog for any reason, Absinth Australian Shepherds will accept puppy back for $0.00. Breeder will either keep said puppy/dog or find puppy/dog a suitable home. When a suitable home is secure, any monies received for the puppy will be reimbursed to the buyer, minus the $500.00 nonrefundable deposit and 15% of initial purchase price. Under NO circumstances may the dog be surrendered to ANY animal shelter. Our goal is to never have any puppies/dogs produced end up in any sort of animal shelter or animal control facility. We will 100% take puppy back.

The dog is sold for the sole purpose of being a companion.

HEALTH GUARANTEE AGREEMENT CONTRACTS

Thank you for choosing a puppy from Absinth Australian Shepherds. Adding a new puppy to your family is a very exciting time but also a big commitment. It's very important that you read over and understand the Health Guarantee Agreement. A lifetime of breeder support is always available for your puppy/dog.

SHORT TERM HEALTH GUARANTEE

This puppy is guaranteed to be in good health, to the best of the seller's knowledge. Buyer has 7 days, from the date of ownership in which to have the puppy checked by a licensed veterinarian. Failure to have puppy checked by a licensed veterinarian within 7 days will void health guarantee. Buyer must email a copy of the vet visit to the seller.

The seller cannot be held accountable for future diagnosis of bacterial or viral infectious diseases, giardia, parasites, fungi, etc. since these can be contracted anywhere in the environment after leaving and are not a result of genetics or breeding. If there is a problem that cannot be rectified the buyer may return the puppy to seller, at buyers' expense no later than the day following the vet exam, along with a veterinarian's statement stating the problem. Upon the puppies return, it will be replaced with another puppy of the same breed when ones available.

Exclusion: This does not include the presence of parasites and does not apply to a health problem resulting from an injury or accident to buyers' negligence. The following provisions will be honored. All medical expenses are the sole responsibility of the buyer. All puppies are vaccinated and treated for worms and giardia before they leave. However, buyer needs to be aware that these things can arise and that they are usually not serious (even though seeing blood in the stool appears serious) and are easily treated and seller will not cover the treatment for them after the puppy leaves our possession. Viral and bacterial diseases and bloody stools (form of worms) are not covered in the health guarantee as they are natural things puppies can pick up from anywhere. Puppies must not be taken to dog parks until they have all their vaccinations. They should also not be taken into pet stores or other high traffic areas until all vaccinations. Umbilical hernias, also referred to as "outie" belly buttons are also not covered in the health guarantee. Puppies are naturally at risk for viral and bacterial diseases and worms which are often brought on by the stress of a new home, new food, new people, or just a change in environment.

LONG TERM HEALTH GUARANTEE

The puppy is guaranteed against congenital life-threatening defects up until 1 year of age. Should anything arise within this time due to a congenital life-threatening defect, the puppy will be replaced by one of the same qualities, and value when the next becomes available. There will be no cash refunds. If the puppy passes the replacement will only be given if a necropsy has been performed and a certificate from a licensed veterinarian is provided as proof of death. The cost of necropsy will be responsibility of buyer. The buyer must contact the breeder immediately upon discovery of a life-threatening defect. any delay in doing so, voids this guarantee. 

The guarantee does not include expenses associated with the vet check, OFA exams, vaccinations, worming medication, transportation, carrier and other fees. The health guarantees mentioned in this agreement do not cover accidental death, neglect, abuse, or injuries that the puppy sustains in the care of the buyer. Any health-related issues or loss of life due to reactions caused by vaccinations or flea and tick preparations administered either orally or on the skin are not covered under this guarantee. No warranty or guarantee is made to the disposition, lifespan, size, color, show quality or breeding quality of any puppy. Retained testicles and hernias are excluded from this guarantee.

VET CARE: Buyer must agree to keep puppy/dog under the care of a licensed veterinarian throughout the dog's lifespan. The buyer agrees to feed this puppy/dog a high-quality dog food appropriate for the breed of dog. If the buyer allows the puppy/dog to become overweight this health guarantee / contract is void. Australian Shepherds that become overweight can develop joint problems, metabolic and digestive disorder, back pain and heart disease. Make sure your Aussies weight is healthy for its height and age. Buyer agrees to keep up with age=appropriate, veterinarian recommended vaccination and deworming regimens.

SHIPPING OF PUPPY: Seller is not responsible for the death or injury of any puppy due to negligence of airline, live animal carrier, or any agent or employee of the airline or animal carrier. All shipping costs relating to any dog being purchased, as well as in any dog being replaced, for any reason, are the sole responsibility of the buyer.
